Yennie Thurman, a woman 34 years of age, was struck by a train of the appellant, and subsequently died. This action was prosecuted by appellee, as her administrator, to recover damages for the benefit of the estate, the husband, and the ■next of kin. From a verdict and judgment allowing such recovery, there is this appeal presenting, inter alia, the issues hereinafter discussed.
