In this proceeding, James Lorrie Dunn seeks a writ of mandate to require respondent superior court to grant his motion to dismiss counts in an information on the ground that those charges had been twice terminated prior to the filing of the information.
The first termination occurred at the request of the People. The People had charged petitioner with violations of Penal Code section 207 (kidnaping), Penal Code section 220 (assault with intent to commit rape) and Vehicle Code section 10851 (theft of an automobile).
