The defendant was charged with the murder of Oliver Vernon Densmore, a regular patrolman of the police department of the city of Los Angeles. He was convicted of murder in the first degree and sentenced to suffer the death penalty. From the judgment of the court and its order denying his motion for a new trial he prosecutes this appeal. He admits that the evidence is sufficient to sustain the verdict of the jury, but relies for a reversal upon alleged errors of the trial court in the giving and refusing of certain instructions, which errors, he claims, vitally prejudiced his substantial…
