Appeal from a judgment of the County Court of Otsego County (Mogavero, Jr., J.), rendered May 28, 1979 upon a verdict convicting defendant of the crime of murder in the second degree. Defendant was convicted of murdering Chad Springett, her two- and one-half-year-old son, and was sentenced to a term of 25 years’ to life imprisonment. The one-count indictment charged her with evincing a depraved indifference to her son’s life for having recklessly engaged in conduct which created a grave risk of death and which caused his death by unjustifiably and inexcusably failing to obtain or provide…
