Kassal, J.
At approximately 1:00 p.m. bn July 7, 1986, defendant, a delivery truck driver, was involved in a traffic accident that left one person dead and four others seriously injured. In this appeal, we are called upon to determine whether the conduct which resulted in this tragedy evinced a depraved indifference to human life on the part of defendant, and thus meets the quantum of proof required to sustain his conviction on several counts of the indictment, including murder in the second degree under subdivision (2) of Penal Law § 125.25.
