The pleadings and record in this case disclose the following alleged circumstances to be the cause of this litigation:

This suit was brought by these two plaintiffs on behalf of themselves and as trustees for their six brothers and sisters; said plaintiffs having secured proper assignments from the remaining parties in interest before suit was filed.
