Affirming.

In the year 1876 Berry Barney bought from George •W. Spears a tract of land in Pike county, Kentucky, containing about three hundred (300) acres, and paid him for it by conveying to him. another tract of land. Thereafter, or before Berry Barney had secured a deed from *237Spears for the land, lie died. On October 21, 1876, George W. Spears conveyed this tract of land to Mazy C.
