Appeal from District Court, Palo Pinto County; J. B. Keith, Judge. Suit by J. N. Haney against the Texas & Pacific Coal Company. Judgment for defendant upon a directed verdict, and plaintiff appeals.

This suit was instituted by J. N. Haney against the Texas & Pacific Coal Company to recover damages for personal injuries received through a fall of a quantity of coal left in the condition it was by the alleged negligence of the defendant. The trial resulted in an instructed verdict and an adverse judgment, and the plaintiff has appealed.

As shown in the court’s charge, the peremptory instruction was based upon two grounds: First, that the evidence failed to show the relation of master and servant between the plaintiff and defendant at the time of the injury; and, second, that the negligence…
