In February, 1901, the plaintiffs in error, James S. Stephens and Oliver J. Westcott, were partners in business as manufacturers of structural iron and steel specialties on premises owned by them adjacent to the Chicago Great Western railway in Maywood, in Cook county, and at that time they started a retail coal business on the same premises under the name of Proviso Coal Company.
