In this diversity contract action we must decide the applicability of two Missouri statutes of frauds, at Mo.Rev.Stat. §§ 432.-010 and 400.2-201(1) (1959), to the oral contract at issue. Appellants, the Padding-ton Corp. and its fully owned subsidiary Morgan Furze, Ltd. (collectively “Padding-ton”), argue that the alleged oral agreement with Appellee Vess Beverages, Inc., for the sale of Paddington’s Steidl Wine Cooler concern, falls within the statutes of frauds and is, therefore, unenforceable.
