The Home Savings Bank of Kalamazoo and the trustees of its segregated assets filed a bill in equity for discovery and for the enforcement of statutory stockholders’ liability against defendants. The bill was filed and summons issued July 13, 1939. Under the notice on the summons to the process server the last day for service was August 12, 1939; and, in event of nonservice, proof was ordered to be filed within five days after August 12th.
