On September 23, 1939, the plaintiff, while a gratuitous passenger in the sedan automobile owned and driven by the defendant Barcomb, was injured when that ear collided with an automobile driven by the defendant Murray. This tort action, having been brought against both defendants to recover the resulting damages and Murray not appearing, the plaintiff had judgment against him by default for the amount of damages assessed by the jury.
