This ease was referred to Trial Commissioner Richard Arens with directions to make findings of fact and recommendation for conclusions of law under the order of reference and Rule 57(a). The commissioner has done so in an opinion and report filed on February 28, 1968, wherein such facts as are necessary to the opinion are set forth. Defendant excepted to that portion of the commissioner’s report which states that plaintiff is entitled to recover on Claim 4, “Closing of Access Roads”, but took no exception to the remaining portions of the opinion covering Claims 1 through 8.
