Plaintiff DLM & A, Inc. (“DLM & A”), filed an amended complaint for temporary, preliminary and permanent injunctive and declaratory relief to prohibit the Department of the Navy by its Naval Sea Systems Command (the “Navy”) from awarding a negotiated contract pursuant to request for proposal N00024-84-R-2146(Q) (the “RFP”) to intervenor ROH, Inc. (“ROH”). An evidentiary hearing was conducted on DLM & A’s motion for a preliminary injunction after its request for a temporary restraining order was mooted by defendant’s agreement to defer award.
