Nicholas Balestrieri filed a declaratory judgment action seeking an interpretation of the applicability of the uninsured motorist endorsement contained in an automobile liability insurance policy issued by Hartford Accident and Idemnity Company. The trial court ruled that the policy conditions for recovery had not been met and that the provisions of the policy were not in conflict with the Arizona uninsured motorist statute. 7 A.R.S. § 20-259.01.
