This case has been twice tried. The defendant in error, Mabel Faulk, secured a verdict and judgment in her favor in the first trial, which was affirmed by the Court of Appeals, but reversed by this court. That case is reported in 114 Ohio St., 572, 151 N. E., 747. The facts are reviewed in the opinion. No useful purpose could be served by a restatement in full detail of the facts here.
