Defendant-appellant, City of Lansing, appeals as of right from a decision of the Michigan Employment Relations Commission (MERC) to affirm in part and modify in part the hearing officer’s decision and recommended order. The hearing officer held that defendant had violated § 10(l)(e) of the public employment relations act (PERA), MCL 423.210; MSA 17.455(10), by refusing to negotiate with the collective-bargaining representative of its fire-fighting employees over the unilateral transfer of unit work to nonunit employees.
