This matter is before the court on cross-motions for summary judgment pursuant to USCIT R. 56, as to Counts One and Two 1 of the complaints filed by Nippon Steel Corporation (“Nippon”), Kawasaki Steel Corporation, ThyssenKrupp Acciai Speciali Terni Sp.A and Acciai Speciali Terni (USA), Inc.
