MEMORANDUM AND ORDER

HOWARD, District Judge.

This habeas corpus petition for review of a conviction and sentence imposed by the Circuit Court of Harford County was brought under 28 U.S.C. § 2254.

I. BACKGROUND

The petitioner Susan Avery was originally tried and convicted in the Maryland District Court in Harford County for violation of an Aberdeen, Maryland obscenity statute. After receiving a sentence of ten days incarceration and a $100.00 fine, petitioner appealed to the Circuit Court for Harford County in accord with Md.Cts. & Jud.Proc.
