KRUEGER, Judge.
The appellant was tried and convicted of the offense of murder, and his punishment assessed at confinement in the state penitentiary for a term of 99 years.
It appears from the record that on the 15th day of August, 1933, the grand jury in and for San Jacinto County, Texas, returned separate indictments against the appellant, J. Lee, and Obie Lee, charging them with the murder of Amon Copeland.
By bill of exception No. 1 appellant complains of the action of the trial court in overruling his application, supported by affidavit, asking for a severance, and that J. Lee- be -first .…
