KRUEGER, Judge.

— Appellant was convicted of the offense of unlawfully selling intoxicating liquor in local option territory, and his punishment was assessed at a fine of $100.00.

Appellant’s first contention is that the court erred in overruling his motion to quash the complaint and information because it failed to negative any exception which might have legally authorized him to sell intoxicating liquor in dry area. This identical question was before this court in the case of Baker v. State, No. 18,666, June 2, 1937 (page 527 of this volume), and was decided adversely to appellant’s…
