This appeal arises from the dismissal of the petition of the John Day Company (John Day), the appellant, seeking damages in contract and in tort from Alvine and Associates, Inc. (Alvine), the appellee. John Day had contracted with an architectural firm for the construction of a building, and the architectural firm had subcontracted with Alvine for mechanical engineering design services.
