This was an action brought by the Hailwood Cash Register Company to recover from Frederick Schroeder and John 0. Dailey, as partners, the amount of eighteen promissory notes of ten dollars each, with interest, executed by the latter to plaintiff in error, as part of the purchase-price of a cash register. Five additional notes were given and paid. Defendant Daily answered alleging that there were defects in the cash register which rendered it useless for the purpose for which it was bought, praying judgment against plaintiff below…
