On July 15, 1977, plaintiff filed a complaint for a writ of superintending control in Wayne County Circuit Court which sought an order directing the defendants to return the petitioner to his position as policeman with full back pay, and, in the alternative, if the writ of superintending control was not granted, requested that the circuit court review the matter as an appeal on the merits. On July 10, 1978, the circuit court issued its order denying a writ of superintending control without prejudice to bringing an appeal on the merits, concluding the civil service commission did not divest…
