I. INTRODUCTION AND PROCEDURAL BACKGROUND
Before the Court is the issue of whether the Emergency Medical Treatment and Active Labor Act (“EMTALA”) applies to Puerto Rico’s “Centros de Diagnóstico y Tratamiento” (hereinafter “CDTs”), an issue of first impression before this Court. Plaintiffs in this case are Joan Rodriguez, Domingo Diaz Rojas, and their conjugal partnership.
