This was an action by the appellee against the appellant for the value of extra iron and steel work, and labor in the building of a new court-house, which work and labor were done and performed by the appellee at the special instance and request of the appellant and its agents.
Issues were joined and there was a trial, resulting in a verdict and judgment for the appellee.
Appellant filed a motion for a new trial, which was overruled, and he excepted, and assigns such ruling as error.
