This is an action in assumpsit by tenant to recover from his landlord’s agent treble damages for rent paid in excess of the maximum under the Federal Housing and Rent Act of June 30, 1947, 61 Stat. at L. 193, as amended, 50 U. S. C. appendix, §§1881, et seq., and to recover reasonable attorney’s fees and costs. The action was instituted on July 1, 1953, against Cowan & Cowan, Inc., the landlord’s agent, hereinafter referred to as defendant. Defendant filed an answer which contained new matter. Richard R.
