I. INTRODUCTION
The plaintiff, Christopher L. Pedrick (“Plaintiff’), brought this action seeking legal and equitable relief to obtain a two-thirds distribution of the proceeds of an annuity account maintained by defendant, TIAA-CREF Individual and Institutional Services, LLC (“TIAA-CREF”). (D.I.59) Plaintiff and his two daughters, defendants Katherine Roten (“Roten”) and Jessica Pe-drick (“Pedrick”), are the beneficiaries of the annuity contract.
