Two propositions are laid down in the prevailing opinion in this case. One of the propositions is that the fourth section of Act No. 300 of 1910, by necessary implication, means that, if a creditor of a bank in liquidation, other than a depositor, fails or neglects, for any reason, to file his claim with the Bank Commissioner and submit proof of the justness of his claim within the limit of time given by the commissioner in the notice which he shall publish, calling upon all claimants other than depositors to file their claims with the commissioner and' “make legal proof as to the justice…
