In May, 1870, Louis Pugh obtained judgment in the .Ballard common pleas court against Sallie May for one .hundred and five dollars, on which judgment execution was issued and levied July 20th, 1870, on a bay mare and colt, rthe property of the defendant in the execution. In August, 1870, the defendant in the execution filed a suit in said court, .asking for a new trial, and that an injunction issue, restraining the plaintiff in the execution from proceeding further in .the collection of his judgment until the disposition of the «questions raised…
