I. INTRODUCTION

The matters before the Court are the “Motion for Approval of Settlement Stipulation” (the “Settlement Motion”) and the “Motion to Vacate This Court’s September 30, 2002 Summary Judgment Order” (the “Motion to Vacate”). The Chapter 7 Trustee (the “Trustee”) and Cummings Properties, LLC (“Cummings”) jointly filed the Settlement Motion; Cummings filed the Motion to Vacate.
