GRAHAM, District Judge.
THIS CAUSE came before the Court upon Defendant MetraHealth, et al.’s Motion to Dismiss Plaintiffs, Response Oncology, Inc. (“ROI”) Complaint.
I. General Statement of Facts
ROI is a nation-wide medical care provider. ROI maintains “IMPACT Centers” 1 throughout the nation for the purpose of administering chemotherapy treatment and advance cancer treatments, including a procedure known as high dose chemotherapy supported by a peripheral stem cell rescue (hereinafter “HDC/PSCR”) to individuals.
