Before the Court is a second round of motions to dismiss filed by the managed care insurance company (“MCO”) Defendants 1 seeking to topple the insured subscriber Plaintiffs’ complaints stating claims under the Racketeer Influenced and Corrupt Organizations Act (“RICO”) and the Employee Retirement Income Security Act (“ERISA”).
