This §§ 1983 method-of-execution case comes before the Court on Defendants’ Motion to Dismiss (doc. 15). The Motion has been fully briefed and is ripe for disposition.
I. Background.
On March 4, 1987, an Alabama jury found Phillip D. Hallford guilty of the capital offense of murder committed during a robbery in the first degree, in violation of Alabama Code §§ 13A-5-40(a)(2). 1 Hallford v.
