This is an application by Kearn J. Mullen, as foreman of the September, 1940, grand jury, to adjudge and punish John J. Halleran for alleged criminal contempt of court. The respondent Halleran brings a cross-motion to vacate the order to show cause and to dismiss the petition. These proceedings arise out of the so-called “ Amen Investigation ” which is being conducted in Queens county before the September, 1940, term grand jury by the Hon.
