Plaintiff’s intestate, a young man twenty-five years of age, sustained fatal injuries on November 13, 1938, when the car which he was driving northerly on Town Line road in Genesee 'county collided, on or near a railroad grade crossing, with the side of a moving westbound passenger train operated by the defendants.
