This is an application for an alternative writ of prohibition, having for its purpose the restraining of the judge of the First judicial district from vacating or setting aside a certain judgment of the district court in and for Nelson county in an action pending therein in which one G. B. Nystrom is the plaintiff and John Lee the defendant. The facts necessary to an understanding of the application are as follows:
