Candler, Justice.

Section 9 of the charter, which the legislature granted the City of Nichols in 1920 (Ga. L. 1920, p. 1329), provides for the election of a mayor and five aldermen on the third Saturday in December of each year. Pursuant to that provision of its charter, December 16, 1961, was the appointed time for the city to elect such officers for 1962. On December 14, 1961, Larry J. Page, Amos Odom, and R. H.
