This appeal is from a temporary restraining order forbidding the Ordinary of Cobb County to hold an election to determine whether the county should permit the manufacture, sale and distribution of alcoholic beverages.

On October 26, 1970, a petition was filed with Max D. Kaley, Ordinary of Cobb County, requesting that a special election be held within 30 days for the purpose of allowing or disallowing the sale of alcoholic beverages and liquors.
