I am unable to agree with the conclusion reached in this case by the majority. The lessee of the sixteenth section lands, Harrington, had leased and’worked said lands for a number of years prior to the year involved in this suit, and had, throughout that period, sold the cot ton grown by him to various cotton buyers, taking checks therefor, placing said checks in the bank, and paying the county by check drawn from the money so received.
