Wayne Johnston, Joe Van Tieghen (sometimes shown in the record as Van Tiegen) and other persons as plaintiffs commenced an action against the city of CofEeyville and the members of its governing body and the county clerk and county treasurer of Montgomery county, to enjoin the collection of assessments against the lots and lands of each plaintiff made by the city in connection with a county road improvement.
