SIMPSON, Circuit Judge:

Defendant-Appellee Jo Ann Williams was indicted, in a two-count indictment, for possession of heroin with intent to distribute in violation of 21 U.S.C. § 841(a)(1) (1976). At trial the district court, prior to placing the defendant in jeopardy, granted defendant’s motion to suppress evidence of two packets of heroin seized by Drug Enforcement Administration (“DEA”) Special Agent Paul J. Markonni. Pursuant to 18 U.S.C. § 3731 (1976)1 the United States appeals from the *88district court’s order granting defendant’s motion to suppress. We affirm.
