Diamond, J.), entered July 30, 2007, dismissing the complaint pursuant to an order, same court and Justice, entered June 13, 2007, which, in an action for defamation between attorneys, granted defendant’s motion to dismiss the complaint for failure to state a cause of action, unanimously affirmed, without costs. Appeal from the above order unanimously dismissed, without costs, as subsumed in the appeal from the above judgment.
