Appeal by the plaintiff, the Press Publishing Company, from a judgment of the Supreme Court in favor of the defendant, entered in the office of the clerk of the county of New York on the 12th day of December, 1912, upon the dismissal of the complaint by direction of the court at the close of the plaintiff’s case upon a trial before the court and a jury at the New York Trial Term.

pf The defendant issued a policy of liability insurance to the plaintiff, insuring it from April 16, 1908, to April 16, 1909, against liability for damage caused by the operation of certain designated automobiles. One of the clauses of the policy provided that “The assured upon the occurrence of an accident shall give immediate written notice thereof, with the fullest *538information obtainable at the time, to the Corporation’s head office at Philadelphia, Pa.
