MEMORANDUM OPINION

These matters come before the Court on the motions of Sean and Carol Flaherty (the “Defendants”) to quash service of process and to dismiss the complaint filed by Norman H. Lehrer (the “Plaintiff’) pursuant to Federal Rules of Civil Procedure 4(m) and 41(b), made applicable here by Federal Rules of Bankruptcy Procedure 7004(a) and 7041. For the reasons set forth herein, the Court grants the Defendants’ motion to quash service of process but denies their motion to dismiss the Plaintiffs complaint.
