BUTZNER, Circuit Judge:

The NCNB Corporation, a North Carolina bank holding company, and two of its wholly owned subsidiaries, North Carolina National Bank and American Trust Company, Inc., brought this action against the South Carolina State Board of Bank Control and various state officials for a declaration that South Carolina Code § 8-580, and portions of §§ 19-592 and 67-53(a)(3) and (4) (1972 Supp.) are unconstitutional and for an injunction restraining their enforcement. Jurisdiction is alleged under 28 U.S.C. §§ 1331 and 1343(3) and is not contested. Submission of the issues to this…
