For brevity the plaintiff in error, which was the defendant below, will be referred to as the defendant and the defendant in error will be referred to as the plaintiff.

The plaintiff recovered a verdict and judgment for $20,500.00 against the defendant. The action was begun by notice of motion for judgment. A writ of error brings the case here. It is sought to have the verdict set aside *770and the judgment reversed on account of the many errors asserted in the petition.
