CROSS, Judge.

On August 21, 1963, judgment was originally entered in plaintiff’s favor upon a jury verdict awarding him damages in the sum of $10,000.00 for personal injuries received when he fell from a truck load of hay while engaged in hay harvest work on the farm premises of defendant. On September 9, 1963, the trial court sustained defendant’s timely motion to set aside the verdict and judgment in favor of plaintiff and enter judgment in favor of defendant in accordance with his motion for a directed verdict, based on allegations (1) that plaintiff’s evidence was insufficient in law and…
