MEMORANDUM OPINION
SMITH, District Judge.
This case is before the court on remand from the Eleventh Circuit Court of Appeals for further consideration of plaintiffs’ as-applied constitutional challenge to an Alabama statute prohibiting the distribution of “any device designed or marketed as useful primarily for the stimulation of human genital organs.” Alabama Code § 13A-12-200.2(a)(1) (1975) (Supp.2001).
