HOLMES, Judge.
Plaintiff appeals from a judgment of voluntary nonsuit induced by the action of the trial court sustaining defendant’s demurrer to the complaint.
The original complaint consisted of one count, Count One. The trial court sustained the demurrers to the original count. This count was amended to read Count One-A, and again the trial court sustained the demurrer interposed by the appellee-defendant, the court filing an opinion as to the reasons for sustaining said demurrer.
